Est-il vrai?

 

Est-il vrai? Que l’herbe repousse après la pluie?
Est-il vrai? Que les fleurs s’épanouiront au
printemps?
Est-il vrai? Que les oiseaux migreront à nouveau
vers leur nid?
Est-il vrai? Que le saumon nage en remontant le
courant?

Cela est vrai. C’est vrai. Et ce sont des miracles.
Mais est-il vrai qu’un jour nous quitteront
Guantanamo Bay?
Est-il vrai qu’un beau jour nous rentrerons chez
nous?
Je vogue dans mes rêves et je rêve, de revenir chez

The Abu Qatada Ruling: An Important Exception

Mr Justice Mitting’s decision today refusing the deportation to Jordan of Omar Othman, popularly known as Abu Qatada, is a significant victory for the British legal system over government pressure. His barrister, Edward Fitzgerald QC at once asked for bail, “there is no justification for continuing to deprive Mr Othman of his liberty. Enough is enough, it has gone on for many years now.”

But the future arrangements for Mr Othman’s life in Britain are complex and uncertain with regard to bail and conditions. The extraordinary politicisation of this case, and the government’s investment in winning was underlined when the Home Office immediately announced they would seek leave to appeal. However, this was refused by the court – the Special Immigration Appeals Commission (SIAC).

This long saga has displayed all the worst elements of the political, legal and social context post 9/11 Britain for refugees, for Muslims, and for those tagged by the security services as related to terrorism.

Secret evidence has been at the heart of Mr Othman’s arrest in 2002, the frequent refusals of bail, two revocations of bail after just a few months when it was finally granted with a restricted regime of 22 hour curfew, electronic tagging, less than a handful of visitors cleared by the Home Office to visit the house, and then only singly. For the best part of a decade he has been incarcerated in a small unit with other Muslim men whom Britain wanted deported or extradited, and where some were driven into full mental illness by the uncertainties of their long prison ordeal, when they had no accusations of any crimes committed in this country. Judge Mitting earlier described the years Mr Othman has been in UK prisons as “extraordinary,” and spoke of a “lamentable” period of time resolving the case.

The End of Tolerance: Statement Discussing the Labour-ConDem Witch-Hunt against the Muslims of Britain

When I read the news earlier today that Umar Uthman, more commonly known as Shaikh Abu Qatada, had been arrested pending deportation on the basis of “diplomatic assurances” from the torturers haven of Jordan, I could scarcely believe my eyes. How far down the road of racism and bigotry has this country gone, MPs seeking to satisfy a baying conglomerate of media and public, eager to take their frustrations of a declining country out on a 52 year old disabled man who they wish to suffer in the most despicable ways.

Not enough was it for them to keep a man without charge for 11 years in captivity, denying him the most basic rights and freedoms, simply because of a despotic government seeking to blame him for their peoples anger against so-called “King Abdullah”. Shaikh Abu Qatadah spent years in a small unit of eight people for no crime or charge, but instead because a foreign dictator demanded his deportation. Britain has now it seemed pandered to a man whose prisons torture 66 in 100 prisoners (Human Rights Watch, 2008). Worse is that this so-called Government of the United Kingdom seems to be encouraging it.

Now, there are those in the blackshirts who might say that he deserves it, where were the rights of the victims, and all the rest of the claptrap that the media likes to wheel out. In the midst of a drunken haze, it could look like a half-point, until we look at the history of the man called Abu Qatada and we see that he has never been involved in any crime.

The solitary charge, for which Theresa May now takes Torturer-in-Chief Abdullah’s words at face value, is one of conspiracy to attack civillians in Jordan in 2000. The only evidence in this Al Qaeda plot (which I am sure will come out in that bastion of virtue, the Jordan Military Court) is an alleged intercepted conversation between Abu Zubaydah and one other individual. The fact that Abu Zubaydah (who still remains without charge in Guantanamo Bay) has been declared by the USA NOT to be a member of Al Qaeda is irrelevant to the wheels of justice in the paranoid terror state of Jordan. More importantly, there is no record of Abu Qatadah knowing any of these individuals, of speaking to these individuals, or indeed any evidence whatsoever of his involvement in any plot (and it is extremely spurious there was never a plot in the first place).

Las Víctimas de la Inquisición estadounidense

The following testimony, entitled “Victims of the American Inquisition” written by Zachary Chesser, is a microcosmic documentation of America’s naked and larger aggression against the religion of Islam in what Chesser terms the ‘American Inquisition.’ Since the intensification of this most recent inquisition, the global Muslim community has suffered a ruthless assault on legal rights and basic humanity, which in various arenas have been superficially designated as everything from geopolitical interests to heretical rhetoric. What Chesser exposes through details regarding his case and subsequent incarceration, is a pattern of federally sanctioned religious persecution and corrosive civil rights violations reflective of American foreign policy, shockingly common in so-called terrorism cases. He recounts how his religious beliefs designated him as a target for government surveillance, how this surveillance in turn became a means of distortion and manipulation, culminating in his incarceration and the deliberate alienation of his family, particularly the religiously charged, custodial kidnapping of his son.

Si se va a saber cuánto estas palabras pueden afectar a mí ya mi familia, entonces la gravedad de este mensaje no se puede escapar. Estoy escribiendo esto con el fin de que nadie debe caer en las mismas trampas y errores como yo, para establecer la prueba para los que dudan, y para rectificar los errores determinados. Tal vez mi ignorancia de la naturaleza de mi situación era una excusa para mí, pero si no, entonces le pido a Dios que me perdone. My name is Abu Talhah Zakariyya al-Amriiki (legally “Zachary Adam Chesser”), and what follows is not to be taken lightly. If you were to know how much these words can affect me and my family, then the gravity of this message would not escape you. I am writing this in order that nobody should fall into the same traps and mistakes as I did, to establish proof for those who doubt, and to rectify certain wrongs. Perhaps my ignorance of the nature of my situation was an excuse for me, but if not, then I ask Allah to forgive me. However, after me, I do not think that anyone will have an excuse in these matters if these events are manifested unto them.

This is my story, and within it are pieces of the stories of many others. It is only a relation of what I know to be true to the best of my ability, and I am sure that what remains hidden from me is far worse than that which was made clear to me, but that which is clear is enough for a person of understanding. Therefore, let these pages be recorded in the annals of history under the chapters reserved for the American Inquisition.

Abu Qatada A Step Closer to Freedom (But Still a Prisoner of the UK System)

The fifty-one year old Omar Othman, Abu Qatada al-Filistini, a Palestinian refugee with Jordanian nationality  has spent the last six years in various maximum security prisons for Category A offenders. Since his original detention in October 2002, every attempt to deport him to Jordan has been frustrated. The law lords ruled three years ago that he could be sent back but the Strasbourg decision overturned that ruling.

The Home Office clashed openly with judges on Monday when it criticised a decision to free on bail, Abu Qatada, who is accused of posing a grave threat to British national security. The decision by Mr Justice Mitting will see Abu Qatada, once described as Osama bin Laden’s righthand man in Europe, walk out of Long Lartin maximum security prison in Worcestershire after more than six and a half years in detention without trial – the longest period in modern times [see footnote].

The Special Immigration Appeals Commission (SIAC) has imposed some of the most draconian bail conditions seen since 9/11, including a twenty-two hour curfew, but this did little to assuage the anger of the Home Office ministers or politicians from all parties at the decision.

The clash takes the battle between politicians and the judiciary into new territory as Abu Qatada is a major international terror suspect. He was first detained without trial in Britain under the quashed Belmarsh regime nearly a decade ago, in October 2002.

The decision taken by the high court judge at SIAC follows the ruling by the European court of human rights that he could not be deported toJordan because he would face a “flagrant denial of justice” – a retrial based on evidence obtained through torture. For the Pleasure of My Lord, The Prisons come Perfumed

لمرضاة رب عزيز كريم * تطيب السجون وتحلو المنون

أخي يا مقيماً بهذي السجونْ  *  إليك أبث بهذي الشجونْ

Dear Brother, who dwells in these prisons To you I write with distresses,

إذا كنـت باللـه مسـتعـصما * فـماذا تضـيرك ريـب المنـون

If to Allah you hold fast Then what harm will a misfortune of time do to you?

حـذاري أخي أن تسيء الظنون * بـوعـد الإلـه القـوي المتـين

Beware dear Brother, of making your corrupting your thoughts Regarding the Promise of the Deity, Mighty and Strong,

فقـد وعـد الـمؤمنين النجاة * كـما نـجّ يونس من بطن نون

Verily, He has promised the Believers with Salvation As He saved Yunus from the dark depths of the belly of the Fish,

أخـي قـد مضى قبلك الأولون * فـهذي السجون كتلك السجون

Dear Brother, before you, passed the ancient ones These prisons are but like those prisons,

فيـوسـف أمـضى بـها مدة * ومـوسـى تـوعـده الظالمون

Did not Yusuf dwelled in them for a phase And Musa, the tyrants threatened him with it,

كـذاك رسـول الإلـه الكريم * ليثـبتـه مَـكَرَ المشـركـون

And such was the Messenger of the Generous Deity To imprison him, the pagans plotted,

فنجـــاه ربـي بـهجـرته * بـرفـقة ذاك الصـديق الأمـين

So my Lord saved him through his Hijrah In the company of that trustworthy friend,

وفـي إثرهم قـد مضى المؤمنون * كـأحـمد ذاك الإمـام المكـين

And in their footsteps, the Believers traversed Like Ahmad, that firm Imam,

كـذاك ابـن تيْـمَةَ أنعم بـه * بقـلعة شـامٍ أقـام ســجـين

And likewise Ibn Taymiyyah was blessed with it In the fortress of Sham, as a prisoner he dwelled,

مئــات ألـوف من الصادقين * أقــاموا زمـاناً بهذي السجون

Hundreds of thousands of the True Faithful Dwelled for a time in these prisons,

فـلا تـضعفنْ يا أخي أو تهون * إذا جــاء دورك أو تسـتكين

Be not weak, dear Brother, nor lose hope When your time comes, nor submit,

تـحصّن بـذكر الإلـه العظيم * وبـادر لـحفـظ الكـتاب المبين

Strengthen yourself by remembering the Deity, Most Supreme And hasten in memorizing the Manifest Book,

فـذاك لقـلبك حـصنٌ حصينْ * وهــذا لروحــك زاد مـعين

That is for your heart a secure stronghold And this is for your spirit an assisting provision,

فـهذي شــدائد سوف تزول * وتبـقى الفـوائــد منـها فنون

These are hardships, soon they will all cease And remaining from it will be various fruits and benefits,

وإن خـوّفـوك وإن هـدّدوك * فـلا تـخـضـعنْ لهمو أو تلين

So if they intimidate you, and they threaten you Never weaken, or soften to them,

وإن شـتموك وإن عـذّبـوك * وإن ضـربـوك فـلا تسـتكين

And even if they insult you, and they torture you And if they beat you, submit not,

فلسـت بأول مـن يـضـربنْ * لــدين عـظيم وشـرع مبين

You are not the first to be tortured For a Mighty Religion and a Manifest Legislation,

ولسـتَ وحـيداً بهذي الطريق * فتـلك القــوافـل عبر السنين

Nor are you alone on this Path For there are countless caravans throughout the years,

وإن مـرّ عـيـدٌ وجـاءَ وليدْ * و‏دارت شـهـورٌ وأنـت سجينْ

And if an ‘Eid passes by, and a son is born And months rotate, while you are imprisoned,

فـلا تبتـئـس يا أخَ الصالحين * لـفـرقـة أهــلٍ وفـقدِ بنينْ

Do not grieve O Brother of the Righteous Ones Of departing from family and losing children,

وإن مـنعـوك زيــاراتـهم * كـذاك رسـائــلهم لا تبـين

And if they forbid you from their visits And likewise their letters never appear,

فــإن كـان هذا لرب ودين * فـأيـن الثـبات وأيــن اليقين

So if this is for a Lord and Religion Then where is the patience, where is the certainty!?

وأيــن كـلامك فيما مضى * بـملة ذاك الرســول الأمين

And where are your past speeches Regarding the (weight of the) Millah of that Trustworthy Messenger?!

فــذاك الـخليل مضى طائعاً * لـذبـح ابنـه فـي بـلاء مبين

That Intimate Friend went willingly To slaughter his son, a clear trial,

بيـوم كـهذا عظـيم كـريم * بـلا جـزعٍ تلّــه للجــبين

On a magnificent, noble day like today Without any anxiety, he put him down upon his forehead,

فنـجـّاه ربـي بإحســانهِ * وأفداه فــوراً بكـبش سمين

So my Lord saved him through His Good Will And ransomed him with a fat sheep,

وأنت بنـوك بعـيـش رغـيد * ولـهو و لـعب وحــرزٍ أمين

But you, your sons are in a carefree life And diversion and amusement, and a secured home,

ولم يـُطلـبنْ مـنك ذبحاً لهم * فـقط أن تصـابر فـراقاً لحينْ

Yet you have not been asked to slaughter them Rather, merely for patience of a temporary separation,

فـهم في رعـاية ربٍ رحـيم * وأنـت بخـلوة ذكـر وديـن

For verily, they are in the care of a Merciful Lord And you are in solitude with Him and Faith,

فـبادر بـحفظ الكتاب المبين * ودع عـنك وسواس ذاك اللّعين

And hasten in memorizing the Manifest Book, and give up longing for those dreaded things

 لمرضاة ربٍ ونصرة ِ دين  *  تهون الحياة وكل البنون

For the Pleasure of a Lord and assisting a Religion, Life and all children become insignificant

لمرضاة رب عزيز كريم  *  تطيب السجون وتحلو المنون

For the Pleasure of a Lord, Mighty and Generous, The prisons come perfumed, and the bitter come sweet

Is It True?

Is it true that the grass grows again
after rain?
Is it true that the flowers will rise up
in the Spring?
Is it true that birds will migrate home again?
Is it true that the salmon swim back up
their stream?

Is it true.  This is true.  These are all miracles.
But is it true that one day we’ll leave
Guantanamo Bay?
Is it true that one day we’ll go back
to our homes?

I sail in my dreams, I am dreaming of home.
To be with my children, each one part of me;
To be with my wife and the ones that I love;
To be with my parents,
my world’s tenderest hearts.
I dream to be home, to be free from this cage.

But do you hear me, oh Judge,
do you hear me at all?
We are innocent, here,
we’ve committed no crime.
Set me free, set us free, if anywhere still
Justice and compassion remain in this world!
