Act Now: The Farooqi Family February Deadline Fast Approaching…

The family of a man jailed for terror offences have told how they are fighting a legal bid to seize their home. Munir Farooqi, 54, was found guilty of preparing for terrorism, soliciting to murder and disseminating terrorist publications. The Crown Prosecution Service now wants to steal his family’s home in Longsight and sell it as part of a Proceeds of Crime prosecution.

They say Farooqi, who distributed religious material from a Longsight market stall, used the basement to radicalise young men into going to Jihad. He was given a life sentence last year following an undercover police operation. He is currently in the process of appealing.

Farooqi’s family, who still live in the house, are fighting the seizure. Campaigners say his wife and daughter own the house and say the action represents collective punishment. Over 15,000 people have signed an online petition supporting them.

His son Harris, 28, who stood trial alongside his father but was cleared of preparing for terrorism, said:

‘I went through the whole trial and lived on bail for a year and a half before being acquitted. Now I face having my house taken away from me. The court said only a small part of the basement was being used for terrorist activities – which we do not believe – so why should the whole house be taken?’

Harris’s wife Juvaria Khalid, mother Zeenat, sister Zulaikha, 22, her husband Robert Fallon, young baby and nine-year-old sister also live in the house. Zulaikha said:

‘I don’t understand why this is happening – we’re all British, we’re all living here and should all have the same rights. We shouldn’t have to go to court to fight for our home but we’ve been really surprised and pleased by the support from the community who recognise this is an injustice.’

The family say police have returned hundreds of religious books and CDs seized from the house during the investigation which were then found to be within the law. Campaigner Naheela Ashraf said: ‘The seizure of this house forms collective punishment against people who are innocent.‘ Under the Terrorism Act the CPS can use a forfeiture order to force the sale of a property used for terrorist purposes, with proceeds given to the courts.

A CPS spokesman said: ‘The CPS is making an application under S23a of the Terrorism Act 2000, for the forfeiture of Munir Farooqi’s home address on the basis that it has been used for the purposes of terrorism. The court will consider the effect of any order on the family members.’

Zulaikha Farooqi: On the Case of Her Father & Other Da’ees (2010)

Assalaamou `alaykoum w rahmatoullah.

I hope this email finds you in the best of health and eman insha’Allah.

May Allah swt bless you, and keep you and your families guarded well in this life and the aakhirah insha’Allah.

Five high-profile dawn raids took place locally in Manchester on 16th November 09. 5 brothers were arrested; one of whom is now released, alhamdulillah.

Three of the brothers by the name of, Munir FAROOQI, Israr MALIK, and Hamza/Mathew NEWTON were active on da’wah stalls and the fourth, Harris FAROOQI, the son of Munir FAROOQI had no link to the dawah stalls in any way.

The charges held against the brothers are no doubt linked to terrorism. This is what everyone hears- but ‘how and why’? are the questions usually left unanswered in most cases…This is why I am mailing today, in order to briefly explain:

  1. what sort of work the brothers initially engaged in,
  2. the misconceptions and accusations held against the brothers which has lead to them being charged,
  3. their current situations, and wellbeing
  4. and most importantly, what we can do as individuals, mosques and a whole community to help the innocent four to be released.

My father, Munir Farooqi, has been accused of intentionally setting up a dawah stall (which he has been holding in Longsight for the past 11 years) to target vulnerable (non Muslim) people, instilling his (Islamic) beliefs into them, befriending them through hospitality and preparing them for jihad. In actual fact all they did was distribute literature, DVD’s and CD’s about Islam, to help people see the true image of Islam. And to stress upon the fact that Islam is NOT associated with terrorism. Many people embraced Islam through the dawah stall, by the guidance of Allah swt and by their own decision, not by force. And this is what the police clearly do not like; hence, they began to investigate and took further action.

This has been a crazy accusation and all those who have met,or know my father know that this is nothing but lies, since nothing of the sort has happened the past 11 years. Yes indeed, he invited people to Islam (but never forced them). Then many people embraced Islam (by their own will). My father invited many people to our house, be they Muslim, or non Muslim (as is the great sunnah of our Beloved Prophet saw). And taught them the salaah and about islam, if new muslims needed help, or then talked about islam, to those who were interested in it. Never did he prepare an army (lol) as these ridiculous people claim. Allah swt is our Greatest Witness & Judge to that.

They are currently held in remand, in prisons across London/Essex. Alhamdulillah,all are doing well and through the help of your sincere dua’s, are in good spirits and firm eman. My father is in Belmarsh and says theres been one shahadah in there and another two interested, because of which they only let my father out of his cell for 20-30 mins a day. Subhanallah, “Their intention is to extinguish Allah’s Light (by blowing)with their mouths: But Allah will complete (the revelation of) His Light, even though the Unbelievers may detest (it).” (Quran 61:8)

We have contact with the brothers, via letters/phonecalls (usually a couple of minutes a day). They send their salaam to all, and request for duaas and thank everybody who have been supporting us.

We have been advised to collect character references explaining what the individuals were like, what you know about their personality, character, what they distributed and if they encouraged/glorified terrorism, or whether they opposed it etc. This would help a lot. The more we have, the merrier.

Please note: There has been a misunderstanding that you have to know the brothers well, personally in order to be able to provide a character reference. This is wrong. The stalls in the City Centre, Longsight and Stockport were all open to the public where anybody and everybody could come. Hence, it can be written by anyone and everyone, from their own perspective- even if they have met just once or merely knew what the brothers distributed at the stall.

If you could please include:
Your name,address,contact number and the character description, then signed at the end. I personally can arrange to collect the character reference once, ready inshallah. However, if you prefer to email me or drop it off by hand, then inshallah that is fine.

There is not a deadline, however, the sooner and the more we can collect the better it would be inshallah. Especially from non Muslims and new Muslims because baring in mind- they are known to be the ‘vulnerable’ people in this case. I request the revert brothers and sisters to please include their initial/previous names first, and then add their new Muslim names (if needed) in brackets, that should leave a good impression inshallah

Please pass on the message to all those you know. You may forward this email onto others if need be inshallah. I also advise everybody to join the Facebook group, FREE MATTHEW NEWTON, to show your support, increase the number of supports by passing the word onto all as well as getting regluar updates, inshallah.

The above was written almost two years ago, since then these brothers have been wrongfuly convicted for nothing more than having Islamic beliefs and for calling the people to Islam. They are currently appealing their cases, May Allah grant them victory in this world and the next, and may He hasten their release, Ameen.

The Farroqi family is still in need of your action and assistance as the the British government is trying to steal their family home, and make three generations, a family of seven including an infant homeless for the ‘crime’ of daw’ah. 

Please stand up for justice and take an active role to Stop the Collective Punishment of the Farooqi Family by writing the British government and signing their Petition before the February deadline.

Zulaikha Farooqi on the Home Invasion of 16 November 2009

As if it were not enough that the Farooqi family endured the traumatic home invasion during the arrest of their father, Munir Farooqi, and the subsequent miscarriage of justice, their very home is once again under attack by the fascist forces. 100,000 signatures are needed before February 2012 to stop the second violation of the Farooqi home.

The Farooqi Family Still in Need of Our Support

An entire family, including a young baby and an eight year-old child, face being thrown out of their family home in Manchester, England, under anti-democratic legislation. The seven members of the family of Munir Farooqi are being threatened with the collective punishment, after he was convicted of terrorist offences and jailed in September of 2011.

The basis for eviction is that the house in the Longsight district of the city was the location of some of the alleged crimes of which Farooqi was convicted. Under the Counter-Terrorism Act 2008, the house is being subject to forfeiture as property, as it was deemed to have been used “for the purposes of terrorism”. The attempt to seize the home and evict three generations of the family is the first time the forfeiture clause in the law has been used since it was passed.

A spokeswoman for the Crown Prosecution Service (CPS) said:

“The power to forfeit residential premises in these circumstances is a new power under the Counter-Terrorism Act 2008, and before any decision is made, the forfeiture application is considered by the court and the family will be given an opportunity to be heard.”

If the order is granted, the property would be sold and the proceeds placed into the Magistrates’ Court. The state is attempting to seize the home, even though it does not belong to Munir Farooqi. The deeds of the property are in the name of his wife, Zeenat Farooqi.

Munir’s son, Harris Farooqi, lives in the house and was acquitted of a charge of preparing for an act of terrorism. He explained:

“It’s a family house. Why is it collective punishment in a democratic society? I don’t understand. We as British citizens work here all our lives and then we’re thrown out onto the streets.”

Munir Farooqi was sentenced to life imprisonment after being found guilty of engaging in conduct in preparation for acts of terrorism, three counts of soliciting to murder and dissemination of terrorist publications. Two other men, Matthew Newton and Hussain Malik, were also jailed following an undercover operation by police from the North West Counter Terrorism Unit (NWCTU). As part of the operation, which was more than a year in duration, undercover police who pretended to become Muslim and sought information and guidance from Munir met with him in his house and made secret recordings of the conversations about Islam that occurred there.

Farooqi and the other defendants in the case denied all the charges against them. And he is currently appealing his conviction. The men were jailed, despite the police finding no evidence that they were actually preparing a crime. Instead, they were jailed on the basis of their “ideology” (thought crimes) which in fact means that they were jailed only because they are Muslim, and for holding Islamic beliefs. Detective Chief Superintendent Tony Porter, the head of the NWCTU, was forced to acknowledge that their was no evidence and that thes men were singled out due to their faith and charged and tried simply for their thoughts and beliefs.  Read the rest of this entry »

Draconian Thought Police Continue Attempts to Steal Home

Hospitality is not a crime, unless the people you’re hosting are undercover police persecuting you for your religious beliefs and personal opinions. The Manchester Police and British government are continuing their efforts to steal the home of the Farooqi family, whose only ostensible crime is that they are the family a man jailed for proselysation despite the fact that International and European conventions consider such actions to be universally unacceptable and illegal acts tantamount to ‘war crimes’.

‘British Justice’ : Forcing Infants & Children Into Homelessness for Others’ Crimes

Local authority and police decisions to seize the homes of family members of those charged in connection with the riots or convicted of terrorist offences punish whole families for one member’s wrongdoing.

Evicting Rioters’ Families

In the aftermath of the August riots, Wandsworth Council served an eviction notice on the mother and 8-year-old sister of 18-year-old Daniel Sartain-Clarke when he was charged with burglary and violent disorder in the riots. Many councils, including Greenwich, Barking and Dagenham, Manchester and Salford declared that they would evict rioters, but apart from Wandsworth, only Southwark Council is believed to have sent out letters warning of eviction to tenants with family members suspected of criminal conduct.

Speaking of the eviction notice, Wandsworth Council leader Ravi Govindia said: ‘There is no room on our estates for people who commit violent crimes, who show no consideration for their neighbours or harass, threaten, intimidate or cause disturbance to others.’ But the Council has been heavily criticised for the decision. Neighbours protest that even if Daniel is guilty, which he disputes, his mother Maite de la Calva is a valuable member of the community, volunteering with a charity helping domestic violence survivors, whose eviction will weaken the neighbourhood, not make it stronger. A picket was held outside Wandsworth magistrates’ court on 6 September to protest the proposed eviction, and even the Daily Telegraph said the proposed eviction was ‘an act of political spite‘.  Read the rest of this entry »

Stop the Collective Punishment of the Farooqi Family

Case Background:

Munir Farooqi is a muslim who ran a “dawah” (Call to Islam) stall in a Manchester market. Two police officers intent on entrapment pretended to convert to Islam through his stall, and then continually visited him and instigated conversations and discussions regarding controversial political issues. Due to clever manipulation of the facts (falsification of evidence) by the prosecutor together with questionable testimony by the authorities, whose previous undercover activities in other police services have included lying on the stand, perjury, by testifying officers, during previous trials involving environmental activists. The unjust and illegal conduct by the officers and prosecutor led to this popular family man as well as two others (Mathew Newton and Israr Malik) being convicted of various spurious charges, clearly drummed up to justify the high cost of a wild goose chase in these times of financial austerity.

Munir Farooqi is now serving life in prison purely because of his alleged beliefs. Tony Porter, head of the so-called “counter terrorism unit”, described the following:

“This was an extremely challenging case, both to investigate and successfully prosecute at court, because we did not recover any blueprint, attack plan or endgame for these men. However, what we were able to prove was their ideology.”

And thus the first conviction for what people think (“thought crimes”), rather than what they do, was secured and begins a frightening trend of persecution for “thought crimes” in this increasingly Orwellian legislation and governance.  Politicians throughout the land, from MP surgeries to Question Time to Parliamentary Reports, utter the now tired mantra “its not a war on Islam”, however the fact that three people were convicted purely because of their ideology, and not for any action, is surely an indication that the times are changing. Muslims are being targeted for their beliefs, to an extent where the police are now willing to finance an operation in which they pretend to accept Islam, only in the sole attempt to elicit incendiary information, in a climate of hate and fear, with the intent of manufacturing a “crime” which is based soley upon ones religoious or polictical belifes and not actual criminal acts or activity. The criminalisation of ones beliefs or opinions is not only a mockery of the genuine beliefs (in this case Islam) held by billions around the world, but also the nominal conventions of freedom of belief, expression and dissenting opinion upheld by democratic society.  Read the rest of this entry »

People of Conscience in UK Stand Up for Justice & Say No to Collective Punishment!

In September of 2011, Munir Farooqi was wrongfully convicted of proselytising and distributing Islamic media. He is currently appealing a verdict of four life sentences from behind bars while three generations of Farooqi’s fight desperately to hold on to their family home.

In an extension of political persecution, the Manchester police have moved to seize the Farooqi family home. If the police application to the court proves successful, the extended Farooqi family, including two young children, will be forcibly and unjustly removed from their home and thereby rendered homeless.

This pursuance of punitive policy against innocent members of the Farooqi family, who are guilty of no crime, is a grievous and outrageous injustice. To punish people free from any wrongdoing for merely being next of kin is contradictory to the ideals of any civilised society and is a deplorable form of collective punishment that should be immediately rectified.

The Farooqi family are appealing to the community to uphold conventional values of Justice and help them keep their family home. Please extend a hand of kindness to a family in desperate need of your support.
